How does the EU Data Act relate to the EU AI Act?

The EU AI Act regulates how AI systems are developed, placed on the market, and used. The EU Data Act governs access to, use, and sharing of data, including data generated by connected products. The two overlap wherever AI systems rely on or generate data that others need to access.

The AI Act sets safety and rights requirements for AI systems themselves. The Data Act, applicable since September 2025, sets rules on who can access data generated by connected products and related services, on what terms, and how data can be shared between businesses and with public bodies.

The overlap appears in data governance. Training, validation, and testing data under the AI Act must be relevant and well governed, and the Data Act can give third parties rights to access data that feeds or is produced by an AI system. Organizations need to know which datasets are subject to which rules before they agree to share them.

Treating the two as separate projects is a common and costly mistake. Legal, technical, and data teams end up with conflicting records of the same dataset. A single data inventory that tags each dataset for both regimes avoids that.

The course aligns AI Act obligations with the data access and sharing rules of the Data Act within one framework, so participants do not have to run two compliance programs.

Expert Insight

Keep one dataset inventory that tags each dataset for both AI Act and Data Act duties. Separate inventories are where conflicting records of the same dataset usually come from.

“One dataset inventory serves both regimes. Two inventories guarantee conflicts.”
